Pharmacists could get money back if legal action succeeds

The funding cuts in England could be put on hold and contractors may even get some money back if the legal action taken by PSNC and NPA against the Government is successful. So said leading lawyer David Reissner of Charles Russell Speechlys at the Sigma conference.

“If the judicial reviews [challenging the legal basis of the cuts] are successful and the minister has to halt the cuts and restart the consultation process, I would expect that, through some mechanism in the Drug Tariff, there would have to be a restoration of the cuts,” Mr Reissner told delegates.

However, he pointed out that, even if the judicial reviews are successful, the Government could carry out another consultation and impact assessment, this time get them right from a legal perspective, and still reach the same decision. “I don’t think we should be under any illusion that the threat is still out there.”

The High Court will consider both the PSNC and NPA judicial reviews in the week commencing March 20.
